Group seeks to intervene in Gessler's lawsuit to prevent ballots to Denver inactive voters | People

A government watchdog group is trying to intervene in a lawsuit filed by Colorado's top elections officer against Denver that seeks to prevent city officials from mailing ballots to inactive voters.
Colorado Common Cause filed a motion Wednesday to be part of the case and argue against Secretary of State Scott Gessler's lawsuit.

The case is scheduled to be heard Friday afternoon in Denver.

Gessler argues that Denver is violating state law by seeking to automatically mail ballots to inactive voters. People who did not vote in the 2010 general election and failed to respond to requests to activate their registrations are considered inactive but are still eligible to vote.

Gessler's decision prompted two Democratic congressmen to ask for a review of the case to see if the lawsuit would violate federal law.
